Terms & Conditions

These Terms & Conditions ("Terms") govern your use of the BringMeSunshine Group website and, unless a product has its own terms, our products OneGoodDeed, OurFamilyRocks and LearnToRead (together, the "Services"). By using the Services you agree to these Terms.

1. About us

The Services are operated by BringMeSunshine Group ("we", "us", "our"), based in New Zealand.

2. Beta programme

The Services are in beta. They are live and real — what you write, upload and share is kept for real — but they are still being built, and by using them you take part in the beta programme.

In plain terms, that means:

• features may change, be replaced, or be withdrawn, sometimes at short notice;
• there may be faults, interruptions and periods where a service is unavailable;
• we may need to reset or migrate data as the design settles, and we will tell you before we do anything that removes content you created;
• the Services are provided as they are, without any promise that they will suit a particular purpose — please do not rely on them as the only place something important is recorded, and keep your own copy of anything you cannot lose;
• we collect more information about how the Services are used during beta than we will afterwards, so that we can find faults and make them better. What that covers, and how long it is kept, is set out in the Privacy Policy.

Nothing in this section takes away rights you have under law, including the consumer guarantees described below. If you would rather not take part, you can close your account at any time — see “Termination”.

3. Use of the Services

You may use the Services only for lawful purposes. You agree not to misuse the Services, interfere with their operation, attempt to gain unauthorised access to them, or use them in a way that harms others.

4. Accounts

Some Services require an account. You are responsible for keeping your login details secure and for activity under your account. You must give us accurate information and keep it up to date. We may suspend or close accounts that breach these Terms.

5. Children and families

Some of our products are designed for family use. Where a child uses a Service, a parent or guardian is responsible for supervising that use and accepts these Terms on the child's behalf.

6. Intellectual property

All content on the Services — including text, designs, logos and software — is owned by or licensed to BringMeSunshine Group and is protected by law. You may not copy, modify or distribute it without our prior written permission, except as allowed by law.

7. User content

You keep ownership of content you submit through the Services. By submitting it, you grant us a non-exclusive, worldwide, royalty-free licence to use it as needed to operate and improve the Services. You are responsible for ensuring your content is lawful and does not infringe the rights of others.

8. Third-party links

The Services may link to third-party websites, including our product sites. We are not responsible for the content or practices of third-party sites, and links do not imply endorsement.

9. Consumer guarantees

Nothing in these Terms limits any rights you have under the New Zealand Consumer Guarantees Act 1993, the Fair Trading Act 1986 or other consumer protection laws that cannot be excluded. If you are using the Services for business purposes, the Consumer Guarantees Act 1993 does not apply to the extent permitted by law.

10. Disclaimer and limitation of liability

The Services are provided "as is" and "as available". To the maximum extent permitted by law, we exclude all implied warranties, and our total liability arising out of or in connection with the Services is limited to NZ$100 or the amount you paid us for the Services in the previous 12 months, whichever is greater. We are not liable for indirect or consequential loss.

11. Changes to the Services and these Terms

We may change or discontinue any part of the Services, and we may update these Terms from time to time. The "last updated" date above shows the current version. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

12. Termination

We may suspend or terminate your access to the Services if you breach these Terms. Sections that by their nature should survive termination (including intellectual property, disclaimers and limitation of liability) will survive.

13. Governing law and jurisdiction

These Terms are governed by the laws of New Zealand. You and we submit to the exclusive jurisdiction of the courts of New Zealand for any dispute arising out of or in connection with these Terms or the Services, except where mandatory consumer protection laws of your country of residence provide otherwise.
